I'm writing this for you to put yourself in a general thought scenario.Just imagine yourself out in the middle of the woods alone hunting and you come upon a Bear(or Bears). What would you do? There might be a choice or two(maybe)you could think of quickly. what you might have done after the fact, you might think of some what if's,but which one would have worked? If any. The Bear has it's own mind.You cannot predict what the bear is thinking of doing and the bear could change it's mind at any point in the course of it's action he or she may have already chosen.The bear definately cannot know what your thinking.I know Bear don't get raised knowing where there boundaries are in the woods.SO WHAT DO YOU DO? Take any number of individuals and put them into this same situation,to test this and the outcome would be the same. Maybe,maybe not.What action does the bear choose? You don't know the bears mood at that moment or even if there are cubs nearby that you never get to see.I know i don't wanna be near any bear, cubs or not.The cubs could make for an even more serious situation,that your not even aware of.I wonder what the Game commission would do? or may have done already that we probably don't know about, in any case we know this would be ok,because were not talking me or you. It's a big world we live in and so many things could happen.Every situation is different.Your not talking the same Bear and the same person every time something happens.Every individual and bear are going to be different.So why fine someone for not having anytime to think of what the game commission apparently thinks should not of happened.This is a real situation and the what if's are something you cannot use during the course of action.They are generally an after thought.The fine was for Taking and Poss of game.To me this means pouching!Should you hesitate to call game comm for help!Makes me wonder!IF YOU READ THE ARCTICAL ON THE NEWPORT MAN AND THE BEAR!THIS WAS MY SON DEFENDING HIM AND HIS OWN LOVED ONES!(AND NOT AGAINST A HUMAN BEING)!SOMETHING I KNOW MANY WOULD HAVE DONE AS WELL. THIS COULD HAVE BEEN AN OBITUARY I'M WRITING,INSTEAD OF A COMMENT,IN HOPES THAT I CAN GET EVERYONE THAT READS THIS BEFORE YOU EVER FIND YOURSELF IN A SITUATION.THINK!THIS CAN HAPPEN TO YOU!

After reading and listening to all the news and information on this story the only conclusion I can come to is that the Game Comission must be run by insensative morons. To fine a man and charge him with poaching , when the man reported the shooting.  Would the Game Comission have paid the cost if the man or his property (ie. his family or his dog) were injured ? That is a rhetorical question because we all know the answer to that.  Under our present economic conditions for them to levee any fine against the property owner is totally ridiculous , especially under the bogus charge of poaching. Hopefully someone from the legal community will come to the aid of this resident.

I guess it ok to shot a dog but not a bear that is after your dog?  That seems to be the law in Perry County.

Yeah, You can't shoot your dog,but the bear can kill it for you!

This whole story is terrible. My husband and I have been looking into this story for a couple of days now. I hope Dustin Lauver's is telling the truth about what led up to this incident ,there is a dead female black bear that probably had little ones that will probably parish.This is not Dustin Lauver's first brush with the law ,the husband and I don't even understand why he is allowed to bare arms.

I think the Commonwealth of Pennsylvania and the Perry county court system is just plain fed up with dealing with you over and over again.Thats why they were so fast to slap you with a fine. When someone keep repeating a statement such as "my wifes gun" it make it apparent that there is more to the story. Mr.Lauver should you even have had your hands on your firearm? Excuse me "I mean your wifes" or any firearm at all? I guess there is more research to be done.

the illegal practice of trespassing on another's property to hunt or steal game without the landowner's permission.


   
       
           
           
       
   
2. any encroachment on another's property, rights, ideas, or the like.



These are the definitions of poaching, so where in this incident did Dustin Lauver trespass onto somebody elses property to illegally take game? Dustin was cited for poaching in which an incident he felt threatened on his own property which gives him every right to defend himself or others on the property. and also in order to poach is to attemp to take the game but in the incident report dustin called the game commision immediatly. now what i dont understand is if dustin Lauver did not commit any definition that pretains to poachin, how can he be cited for wat he has not commited.

thank you prancer.  there is always more to things than meets the eye.  it isn't just random persecution all the time.  It appears that Mr. Lauver as part of public record isn't quite the unimpeachable witness....as his record reveals a history of criminal mischief,  possession of controlled substance, disorderly conduct, harrassment (multiple counts), possession/ manufacturing/ dealing, operating a motor vehicle without insurance, etc etc....

*sigh*

the above posting was only for perry county arrests or prosecutions..additionally in researching other counties Mr. Lauver was arrested in....

       
  • speeding

  •    
  • careless driving

  •    
  • simple assault

  •    
  • involuntary servitude/ unlawful restraint

  •    
  • possession/ use drug paraphenila

  •    
  • operating unsafe equipment



I'm sorry, but I lived in the pocono mountains where black bears and all sorts of bears reside.  They are all over the place.  generally if you leave them alone, they leave you alone.  If you feel threatened by the presence of a bear, make one simple phone call.  It doesn't take but a second.  I used to run into bears on a daily basis..... I never felt the urge to run for a gun or other weapon...  To me, this man just seems like a loose cannon who didn't need much of an excuse to play with guns.

Dustin and Mary are getting what they deserve. Dustin had lived in the woods his entire life he knows the rules of hunting. He didnt know what was out in the woods although he did make it a point to keep saying that the gun was Mary's because here's a little tid bit of info he isn't allowed to have one. I don't exactly know what was going through his mind at the time but I do know that he knew what he was doing. He killed a mother bear the thing of the matter is that he didn't know what was out there reguard less of the trespassing signs for all he knew it could have been a hunter who was lost in the woods and heard a dog bark and thought that he could find his way home and then there is this maniac shooting at him. I'm sorry but I am siding with the game commission on this one.

The husband and i will be making a trip to New Bloomfield first thing tomorrow morning to have a chat with Mark Keller( Legislator) to have some conversation.
